Terms of Service

1. The Service

Easy Clarity 4 Growth is a Nationally Consistent Collection of Data (NCCD) compliance and student support planning application provided by Easy Clarity 4 Growth Pty Ltd (ABN 70 698 484 632, ACN 698 484 632). Schools use Easy Clarity 4 Growth to record student diagnoses, imputed disabilities, functional impact statements, adjustments, goals, meetings, plans, and related evidence required for NCCD funding submissions and day-to-day learning support.

The Service is hosted on Google Cloud infrastructure in australia-southeast1 (Sydney). No school data is processed or stored outside Australia at any time.

2. Eligibility

Easy Clarity 4 Growth is available to registered Australian schools (primary, P-12, and special schools). Access is granted to staff nominated by the school's Principal or authorised delegate. Each user must authenticate via the school's Google Workspace domain or an approved email address.

3. Accounts and access

User accounts are created by the school's leadership within Easy Clarity 4 Growth. Each user is assigned a role (Owner, Leadership, Executive, Assistant, Specialist, Intervention Teacher, Classroom Teacher, ESO, or Custom) determining what data they can see and edit. The school is responsible for keeping its user list current and revoking access when staff leave.

4. Permitted use

Schools may use Easy Clarity 4 Growth for:

• Recording student support information for the school's own enrolled students
• Generating NCCD evidence portfolios and reports for the school's own funding submissions
• Sharing reports internally with school staff who have a legitimate educational interest

Schools may not:

• Resell, sublicense, or share access with any third party
• Use the Service for any student not enrolled at the school
• Use the Service for any purpose other than student support and NCCD compliance recording
• Attempt to access, modify, or extract data belonging to other schools

5. Data ownership

All data entered into Easy Clarity 4 Growth by the school or its staff, including student records, notes, plans, meetings, attachments and reports, is owned by the school. Easy Clarity 4 Growth Pty Ltd is a data processor acting on the school's documented instructions.

Easy Clarity 4 Growth Pty Ltd claims no ownership, copyright, or commercial rights over any school data. School data will not be used for product analytics, marketing, model training, or any purpose other than delivering the Service.

6. Data residency and security

All data is stored in Australia (Google Cloud, Sydney region). Security measures include:

• TLS 1.2+ encryption in transit, AES-256 encryption at rest
• Role-based access control enforced server-side via Firestore security rules
• Audit logging of every read, write, and delete on student records
• Automated weekly backups to encrypted Cloud Storage

7. Artificial intelligence

Easy Clarity 4 Growth includes optional AI features that assist staff with drafting, summarisation, and documentation completeness checking. When AI features are used:

• All personally identifiable information (names, emails, phones) is removed on the user's device before any data is sent to the AI
• AI processing occurs in Australia only (Google Vertex AI, Sydney)
• Google Vertex AI is configured with a zero data retention policy and is contractually prohibited from using school data for model training
• AI outputs are advisory only, and staff must review and confirm before any data is saved

Schools can disable all AI features from the Settings page at any time. The platform functions fully without AI enabled.

8. Privacy

Easy Clarity 4 Growth Pty Ltd complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Full details are set out in our Privacy Policy.

9. Termination and data return

Either party may terminate the agreement with 30 days written notice. On termination, Easy Clarity 4 Growth Pty Ltd will:

1. Export all school data as machine-readable files within 7 days
2. Delete all school data from active systems within 30 days
3. Delete data from backup systems within 37 days
4. Provide written confirmation of deletion

10. Availability

Easy Clarity 4 Growth Pty Ltd will use reasonable efforts to maintain the Service's availability. Planned maintenance will be communicated in advance where practical. The Service depends on Google Cloud infrastructure; Easy Clarity 4 Growth Pty Ltd is not liable for outages caused by Google Cloud.

11. Insurance

Easy Clarity 4 Growth Pty Ltd maintains Professional Indemnity insurance, Cyber Security insurance, and Public Liability insurance. Insurance certificates are available on request.

12. Limitation of liability

To the maximum extent permitted by law, Easy Clarity 4 Growth Pty Ltd's total aggregate liability is limited to the total fees paid by the school in the 12 months preceding the claim. Neither party is liable for indirect, consequential, or punitive damages.

13. Compliance

Easy Clarity 4 Growth Pty Ltd warrants compliance with:

• Privacy Act 1988 (Cth) and the Australian Privacy Principles
• Notifiable Data Breaches scheme
• Disability Discrimination Act 1992 and the Disability Standards for Education 2005
• Australian Education Regulation 2023 (NCCD)
• Child Safe Standards (Victoria) and the National Principles for Child Safe Organisations

14. Changes to these terms

Material changes will be communicated to school principals at least 30 days before they take effect. Continued use after that period constitutes acceptance.

15. Governing law

These terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of Victorian courts.
